Let’s say hypothetically that marijuana seeds have been planted in your garden, via bird droppings for example, and they grow to beautiful plants – are you legally responsible for being able to recognize them as marijuana plants and not just a nice wildflower you enjoy looking at? In other words, are you LEGALLY required to recognize this plant, and what happens if you don’t and you’re reported to the authorities??

well i think you know what it is and are probably trying to grow it from the way you are talking. marijuana seeds dont fly out of birds. any dumbass knows what mj looks like just from the leaf, yeah you can get in trouble for cultivation, not that much if you only have one plant and claim you dont know what it is. they wont believe you anyway. you wont get caught, if the cops find out then your friends really arent your friends.
That’s a very interesting question to which I have no answer.
But I would like to point out that there really is no way for the seeds to end up in your garden unless someone puts them there. There is no marijuana fruit that any birds would eat to ingest the seeds. There are no wild marijuana plants which would even produce seeds to be dispersed. And finally, if someone were growing pot, they would purposefully avoid fertilization of the plants, so hardly any seeds would be produced.
You won’t believe this but how the law is usually applied to the situation is this:
Say you were a farmer and someone (bird or local grower) planted some seeds behind your barn. You discover them and call the cops. Your barn is arrested. I know this sounds insane but it has happened. Our leagal system just isn’t set up to handle the situation and with all the “war on drugs” crap written during president nancy’s (ronald’s wife) term someone has to be responsible. The end of this is it is a very big hastle for the farmer (or gardener) and you don’t want to get involved. If you grow hide them well, you can’t just claim ignorance and get away with it.

this actually happened to my mothers neighbor, don’t know how the seeds got there but somehow they did, she was weeding her garden (it was pretty over grown) putting the plants she liked into terracotta pots, she thought it was pretty so she showed my mother, she honestly didn’t have a clue what it was
after my mother told her they put it on the compost, probably not the “right” thing to do but she didn’t want to risk the police getting the wrong idea
Ignorace is no excuse for the law. Everyone knows that.
